Run Coaching Client Terms and Conditions

This agreement (“Agreement”) is made and entered into between Green Strides Fitness (“Coach”) and the undersigned client (“Client”). By engaging in coaching services, the Client agrees to the following terms and conditions.

1. Description of Services

The Coach agrees to provide online run coaching services, which may include, but are not limited to:

  • Personalized training plans and schedules.
  • Regular communication and feedback via email, messaging, or other agreed-upon platforms.
  • General guidance on running, fitness, and race and training nutrition.

The Coach is not a medical professional, physical therapist, or registered dietitian. The services provided are for general fitness and performance purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

2. Client’s Responsibilities

The Client agrees to:

  • Be truthful and transparent about their health, fitness, medical history, and any existing injuries.
  • Consult with a doctor/physician before beginning run coaching and undertaking any significant modifications throughout.
  • Follow the training plan to the best of their ability, while also listening to their body and making responsible decisions about their health.
  • Inform the Coach immediately of any injuries, illnesses, or changes in health status.
  • Communicate regularly with the Coach as outlined in the coaching package.
  • Ensure all payments are made on time as per the payment terms.

3. Health and Safety Disclaimer

The Client acknowledges that running and physical activity carry inherent risks, including but not limited to, muscle strains, fractures, heart attacks, and even death. The Client voluntarily participates in these activities with full knowledge of the risks. The Client assumes all responsibility for their safety and waives any claims against the Coach for injuries, damages, or death.

4. Payment and Billing

  • Payment: The Client agrees to pay the fees for the coaching services as outlined in the chosen package. All fees are due in advance of the service period.
  • Invoicing: Invoices will be sent via email.
  • Late Payments: A late fee of 5% may be applied to payments that are more than 14 days past due.
  • No Refunds: All payments for services rendered are non-refundable.

5. Cancellation and Termination

  • Client Cancellation: The Client may cancel this Agreement at any time after an initial 3-block coaching period, by providing 14 days written notice. No refunds will be issued for the remainder of the current billing cycle.
  • Coach Termination: The Coach reserves the right to terminate this Agreement at any time if the Client fails to comply with these terms, including late payments, or if the coaching relationship is deemed no longer productive or appropriate. In such a case, the Coach will issue a pro-rated refund for any unused services, unless the termination is due to a breach of this Agreement by the Client.

6. Confidentiality

The Coach will maintain the confidentiality of all personal information and performance data shared by the Client, except as required by UK law. The Client agrees that the Coach may use anonymized data for testimonials, case studies, or marketing purposes with the Client’s written consent.

7. Data Protection

The Coach is committed to protecting the Client’s personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. The Coach will act as a data controller, processing the Client’s personal information (including, but not limited to, name, contact details, and health data) solely for the purpose of providing coaching services. The Client has the right to access, rectify, or request the erasure of their personal data, and the Coach will implement appropriate technical and organizational measures to ensure its security and integrity.

8. Limitation of Liability

The Coach’s liability to the Client for any claim, loss, or damage arising out of this Agreement shall not exceed the total amount of fees paid by the Client to the Coach during the 1-block of coaching preceding the event giving rise to the claim. The Coach shall not be liable for any indirect, consequential, or incidental damages.

9. Intellectual Property

All training plans, guides, and materials provided by the Coach are the intellectual property of Green Strides Fitness. The Client is granted a non-transferable license to use these materials for their personal use only and may not reproduce, distribute, or share them with others without the Coach’s express written consent.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the UK.

11. Acceptance of Terms

By paying the initial invoice and/or beginning the coaching services, the Client acknowledges that they have read, understood, and agreed to all the terms and conditions outlined in this Agreement.
